Terms of Service & Purchase Agreement
1. Acceptance of Terms
Welcome to Captains Business Academy (the "Academy," "we," "us," or "our"). By visiting our website, accessing our free resources, or purchasing our courses (including "The Captains Business Academy" course), you agree to be bound by these Terms of Service ("Terms").
If you do not agree with these Terms, please do not use our website or purchase our products.
2. License to Use
By purchasing "The Captains Business Academy" (the "Course"), you agree to the following:
Upon purchase, we grant you a limited, non-transferable, non-exclusive, revocable license to access the Course materials for your personal business development.
Single User Only: This purchase grants access to one individual. You may not share your login credentials with other captains, business partners, or employees.
No Resale: You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Course.
3. Intellectual Property
All content included in the Course (including but not limited to videos, worksheets, business templates, checklists, and text) is the property of The Captains Business Academy and is protected by copyright laws.
Templates: You are permitted to use the provided business templates (e.g., the "Captain’s Financial Engine," accounting spreadsheets, charter contract templates) for your own personal charter business operations.
Restrictions: You may not resell, sub-license, or redistribute these templates as your own commercial products or "white label" them for other academies.
4. Educational Disclaimers (Read Carefully)
The Captains Business Academy is an educational resource intended to help you understand the business side of running a charter operation. We are educators, not attorneys, CPAs, or maritime safety officers.
A. Not Legal or Maritime Advice
The information contained in this Course is for general educational and informational purposes only.
Not Legal Counsel: This Course does not constitute legal, accounting, or tax advice. You should consult with your own attorney or accountant regarding specific legal or financial situations, including entity formation (LLC vs. Sole Prop).
Maritime Regulations: While we discuss the business of boating, this Course is not a substitute for official United States Coast Guard (USCG) regulations or maritime law advice. You remain solely responsible for maintaining your captain's license and adhering to all maritime safety laws.
B. Earnings and Results Disclaimer
No Guarantees: We make no guarantees as to the income, revenue, or success you may achieve by applying the information provided in this Course. Your results depend on a variety of factors, including your background, dedication, desire, local market conditions, and the demand for charters in your area.
Business Risks: All business entails risk as well as massive and consistent effort and action. If you're not willing to accept that, please do not purchase this product.
C. Safety and Navigation
Not Fishing or Navigation Advice: We teach business systems. We do not provide instruction on navigation, boat handling, or fishing tactics.
Jones Act & Liability: Any discussion regarding crew liability, the Jones Act, or insurance is for educational awareness only. Maritime injury law is complex; you must consult a maritime attorney to ensure your specific insurance policies and crew agreements are compliant. We are not liable for any regulatory fines, insurance denials, or legal judgments against your vessel.
5. Refund Policy
We stand behind our training with our "Fuel in the Tank" Guarantee (30 Days).
We don't believe in "something for nothing," and neither do you. We are confident that the Captains Business Academy will pay for itself within your first few trips. However, we also know that buying digital tools can be a risk.

If you honestly feel that these tools did not clarify your business or save you money, simply email us your completed worksheet within 30 days of purchase, and we will refund you 100%.
6. Payment Plans
If you opt for a payment plan at checkout:
You are responsible for completing all scheduled payments.
If a payment fails, we will attempt to process it again.
If payment fails repeatedly, your access to the Course will be suspended immediately until the account is brought current.
7. Community Code of Conduct
If the Course includes access to a private community (e.g., Facebook group, Circle, Discord):
You agree to treat other captains and members with respect.
Harassment, hate speech, or spamming will result in immediate removal from the group without refund.
8. Third-Party Links and Tools
Our Course may reference third-party tools (e.g., QuickBooks, Wave, FareHarbor, Peek). We do not own or control these companies. We are not responsible for the functionality, privacy policies, or terms of use of any third-party software you choose to adopt for your business.
9. Limitation of Liability
To the fullest extent permitted by law, you agree that under no circumstances shall The Captains Business Academy (or its owners, employees, and affiliates) be liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Course or any errors or omissions in the content.
Specifically: We are not liable for any financial losses, business failures, or maritime accidents associated with your charter operation. You run your own boat; we simply provide the educational charts.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Insert Your State], without regard to its conflict of law provisions.
